Legal department
The Legal Department of the State Tax University (hereinafter – the Department) operates in accordance with the Regulation on the Legal Department of the State Tax University, approved by Order of the State Tax University No. 348 dated March 30, 2023.
The Department is directly subordinate to the Rector of the University. The structure and job descriptions of the service personnel are approved by the Rector in the established manner.
The primary objective of the Legal Department is the organization of legal work aimed at the correct application, strict adherence to, and prevention of non-compliance with the requirements of legislative acts, as well as the representation of interests in courts.
The University Legal Department:
- Ensures the correct application of regulatory legal acts and other documents within the institution and submits proposals to the head regarding the resolution of legal issues related to the institution's activities.
- Develops and participates in the development of drafts, acts, and other documents concerning the institution's activities.
- Conducts legal expertise of drafts, acts, and other documents prepared by the institution's structural units, and approves them provided there are signatures from the heads of the relevant structural units or their deputies. In the event of identifying discrepancies between a draft, act, or other document and the requirements of legislation, it submits reasoned proposals to the relevant structural unit to bring it into compliance with the legislation.
- Conducts, together with the institution's structural units, work on the review of acts and other documents within its competence for the purpose of bringing them into compliance with the legislation.
- Informs the head of the institution about the necessity of taking measures to amend, repeal, or cancel acts and other documents.
- Organizes work related to the conclusion of agreements (contracts), participates in their preparation and monitoring of their execution, and provides legal assessment of drafts of such agreements (contracts). Draft agreements (contracts) are approved by the legal service provided there are signatures from the heads of the relevant structural units or their deputies.
- Participates in ensuring the protection of property rights and legitimate interests of the institution in the event of non-fulfillment or improper fulfillment of contractual obligations.
- Exercises control over the observance of the established procedure for filing and reviewing claims by the institution's structural units.
- Organizes claims and litigation work and conducts analysis of its results.
- Facilitates the timely implementation of measures to eliminate violations specified in prosecutorial response documents, court decisions, and relevant documents of law enforcement and supervisory authorities.
