Legal department
The staff of the Legal Service of the State Tax University consists of the Head of the Legal Service, the Deputy Head of the Legal Service and leading legal advisers in the amount of 4 persons.
The Legal Service of the State Tax University (hereinafter referred to as the Service) is guided by the Regulations on the Legal Service of the State Tax University approved by the Academic Council of the State Tax University dated 27.01.2022 No. 3.
The Service is directly subordinated to the Rector of the University. The structure, staffing, Regulations, job descriptions of the employees of the Service are approved by the Rector in accordance with the established procedure.
The main task of the legal service is to organise legal work aimed at the correct application, strict observance and prevention of non-compliance with the requirements of legislative acts, as well as representation of interests in courts.
University Legal Service:
- Ensures the correct application of regulations and other documents in the institution, submits proposals to the head to resolve legal issues related to the institution's activities.
- Develops and participates in the development of drafts, acts, and other documents related to the institution's activities.
- Carries out legal examination of drafts, acts and other documents prepared by the institution's structural units, approves (visits) them if the heads of the concerned structural units or persons replacing them have visas. If a draft, act or other document is found to be inconsistent with the requirements of the law, he/she shall submit to the concerned structural unit motivated proposals for bringing it into compliance with the law.
- Together with the institution's structural units, review acts and other documents within its competence to bring them into compliance with the law.
- Informs the head of the institution about the need to take measures to amend acts and other documents, declare them invalid or cancel them.
- Organises work related to the conclusion of agreements (contracts), participates in their preparation and control over their execution, and provides legal assessment of draft agreements (contracts). Draft agreements (contracts) shall be approved (endorsed) by the Legal Service if the heads of the concerned structural units or persons replacing them have visas.
- Participates in ensuring the protection of property rights and legitimate interests of the institution in case of non-fulfilment or improper fulfilment of contractual obligations.
- Controls compliance by structural units with the procedure for filing and reviewing claims established by the institution.
- Organises claims and lawsuits, analyses their results.
- Facilitates timely action to eliminate violations identified in prosecutorial response documents, court decisions, and relevant documents of law enforcement and regulatory authorities.
